Transfer duties: Granby called to order

The City of Granby is called to order by the court as to how it invoices transfer duties – commonly called “welcome tax” – to building contractors.
In a recent judgment, the civil chamber of the Court of Quebec ordered the municipal administration to reimburse $ 92,106.26 collected in excess to the company Gestion Marc Breton.

The City had demanded that the building contractor pay transfer taxes as much for land he bought as for the houses he then built.

However, in this case concerning notarial law, judge François Bousquet rejects all of the City’s arguments and agrees with the entrepreneur who demanded a reimbursement. The transfer tax, in these cases, must be established “on the value of the land alone”.

“If you buy a bumper but not a car, you don’t pay taxes on the car, it’s common sense”, illustrates a notary contacted by La Voix de l’Est and who accepted to comment on this judgment while remaining anonymous. He maintains that Granby has been fishing for several years by excess of “greed” regarding real estate development, which has been done at high speed in several districts.

“The entrepreneur [under construction] does not buy his house, he builds it. The City tried to collect transfer duties on goods that were not sold. In short, she was ambitious. ”

The City of Granby did not call back La Voix de l’Est on Wednesday, but a resolution adopted by city council on March 16 indicates that it will appeal this judgment. She “disagrees” with the interpretation of the law made by Justice Bousquet.

It was also not possible to reach a representative of Gestion Marc Breton.

The notary contacted by La Voix de l’Est believes that this judgment will set a precedent and will be beneficial to real estate developers across the province.
