Transfer duties: Granby called to order
The City of Granby is called to order by the court as to how it invoices transfer duties – commonly called “welcome tax” – to building contractors.
In a recent judgment, the civil chamber of the Court of Quebec ordered the municipal administration to reimburse $ 92,106.26 collected in excess to the company Gestion Marc Breton.
The City had demanded that the building contractor pay transfer taxes as much for land he bought as for the houses he then built.
However, in this case concerning notarial law, judge François Bousquet rejects all of the City’s arguments and agrees with the entrepreneur who demanded a reimbursement. The transfer tax, in these cases, must be established “on the value of the land alone”.

He maintains that Granby has been fishing for several years by excess of “greed” regarding real estate development, which has been done at high speed in several districts.
